Simon Hughes successful in strike out appeal

Kevin Cowley v LW Carlisle Company Limited – Appeal before HHJ Rawlings on 14th November 2018.

 

DWF successfully applied for this occupational deafness claim to be struck out and then resisted the Claimant's appeal of the District Judge's strike out order. The case was handled by Patrick McBrien, Director in our Catastrophic Injury & Occupational Health team. Simon Hughes, Counsel from Civitas Law, successfully represented the Defendant at the Appeal.

Anthony Vines represents Bridgend County Borough Council in important school health and safety case

On 2 November 2018, Anthony Vines appeared at the sentencing hearing of the Council in Cardiff Crown Court before the Recorder of Cardiff.  The Council was committed for sentence from Cwmbran Magistrates Court where it had pleaded guilty to the single charge brought by the HSE of breaching s.3(1) of the HSWA 1974 over a period from 1 September 2008 to 10 December 2014.

Richard Cole undertakes in depth reviews for the Independent Office for Police Conduct

Richard Cole has completed two in depth independent reviews into closed investigations undertaken by the Independent Office for Police Conduct (previously the IPCC). The work was commissioned by the Quality Control Unit of the IPCC and involved reviewing a large number of investigations carried out by all of the IPCC’s offices across the UK. Richard’s work took place between September 2017 and September 2018 and will be used to identify and maintain areas of good practice, as well as improve standards within investigations.

Dominic Evans begins pupillage at Civitas Law

Chambers is delighted to welcome Dominic Evans as a pupil.

After growing up in Neath, Dominic went on to study Law at Cardiff University and graduated with First Class Honours. He thereafter completed the Bar Professional Training Course at the University of Law in London, attaining a Very Competent.

Owain Rhys James granted permission to appeal to the Court of Appeal

Owain Rhys James has been granted permission to appeal the dismissal of an application for a stay of proceedings pursuant to Section 9 of the Arbitration Act 1996. He acted for the Appellant at first instance (then as the Applicant) and at the first appeal before HHJ Vosper QC. Permission has now been granted for a second appeal to proceed to the Court of Appeal.

Richard Cole successfully represents the Official Receiver at a rare contested Bankruptcy Restriction Order application.

The Official Receiver applied for a BRO in circumstances where the Respondent, who was subject to a bankruptcy petition at the material time, disposed of a sizeable asset and spent the proceeds to the detriment of his creditors.
