Catrin Gregory-Wallace successful in defending possession claim before the DCJ for Wales

Catrin Gregory-Wallace, instructed by Shelter Cymru, successfully defended a claim for possession under s173 of the Renting Homes (Wales) Act 2016. The claim raised novel issues of interpretation and was heard by HHJ Harrison, the Designated Civil Judge for Wales.

 

The Defendant successfully argued that notice had not been validly served pursuant to Schedule 9A of the Act. The judge agreed, finding that the landlord had not proven that they had complied with their obligations under s31 of the Act, by providing a converted contract to the contract holder within the relevant period.

The landlord’s claim for possession therefore failed.
