Court of Appeal clarifies Hire Purchase Act
The Appellant in Rohit Kulkarni – and - Manor Credit (Davenham) Ltd [2010] EWCA Civ 69, represented by Nick Thomas-Symonds, led by Christopher Purchas, QC, won a significant victory for purchasers of motor vehicles in good faith.
The Court of Appeal has clarified the interpretation of section 27 of the Hire Purchase Act 1964 which provides a rare exception to the general principle of English law that no one can transfer a better title than he possesses (nemo dat quod non habet). More detail are to follow.
