16.01.2010Gilham case reported in The Times The Times reports important intellectual property and public protection case.
The widespread significance of the decision in Gilham (Court of Appeal - 9 November 2009) continues to be recognised as it has now been reported in The Times (12 January 2010) as well as various other legal and other publications.
The importance of the case in the ongoing international battle between those manufacturing gaming consoles, such as Microsoft, Nintendo and Sony, and the chipping community can be seen from the timing of the decision shortly before the initiative was taken by Microsoft against chippers by restricting access of those using chipped Xbox consoles to the online service.
Early signs are that the decision is resulting in an increase in enforcement action both by copyright owners and trading standards departments who can now choose to rely upon an apparent simplification of breaching copyright as suggested by Burnton LJ.
