Public law, planning and regulatory

Anthony has over 14 years’ experience of advising and representing clients including high street names in criminal and civil jurisdictions, before inquiries and before regulators such as the Office of Fair Trading in respect of trading, licensing, administrative and enforcement issues.

Anthony is instructed by local authorities, regulators, government departments, businesses such as the Royal Mail, and individuals in advisory work and prosecutions ranging from trading standards and environmental health to care standards, planning enforcement and fraud. He has been instructed amongst others by the Commission for Social Care Inspection, the National Assembly of Wales and the HSE.  He has considerable experience in the representation of due diligence defences and local authority procedures.  He is familiar with restraint and confiscation procedures and judicial review.

He is appointed both to the Attorney General's Panel of Prosecuting Advocates and to the Welsh Assembly Government's Panel.

The Legal 500 (2011) states that Anthony is: 'an excellent commercial all-rounder with a useful niche in trading standards work – he was recently successful for Worcestershire County Council before the Court of Appeal in R v Gilham, a leading case on computer game copyright.'

Anthony was also recommended for trading standards, environmental, planning and care standards work in the Legal 500 (2009).


Commercial and Chancery

Acting both for businesses and individuals, Anthony regularly advises and represents on contract and consumer protection matters such as terms and conditions, the enforceability of agreements and disputes concerning the sale of goods or the supply of services.

Anthony also is experienced in handling both internal and external company disputes involving fraudulent conduct both in the criminal and civil courts and where injunction proceedings are required.

Employment

Anthony advises and represents employers, unions and employees.  Recent advisory work has included TUPE transfers and disciplinary codes. Recent tribunal hearings have concerned discrimination, protected disclosures and protective awards. Lectures and seminars for the Law Society in relation to redundancies.


CivitasADR

Anthony conducts lead mediations in bi-party and multi-party disputes of value with issues of professional negligence, planning, contract law and costs.  He has considerable experience with community mediation including racism, homophobia, noise nuisance and other neighbourhood issues.

He has mediated for the Court of Appeal Mediation Scheme, CEDR, Southwark Mediation Centre, Independent Housing Ombudsman and the South and West Wales Court Mediation Scheme.


NOTABLE CASES

• R v Gilham [2009] EWCA Crim 2293 CA [2009] WLR (D) 324 – Instructed by Worcestershire County Council in Crown Court prosecution of retailer of modchips for Xbox, Nintendo and Sony Playstation under copyright, trade marks and proceeds of crime legislation.  Business turned over £850,000 over two years. Restraint proceedings and funds being removed from the jurisdiction. Case appealed
unsuccessfully on whether a copy within copyright legislation was created (click here for article).

• Represented Bridgend CBC at the Public Inquiry chaired by Professor Pennington into the 2005 e. coli outbreak.  Evidence concerned public procurement, food hygiene and school management.  

• CPS v Jones – Successfully defended individual accused of deliberately disturbing a dormouse habitat.

• Caerphilly CBC, RCT CBC & Bridgend CBC v Tudor – Led by Graham Walters in prosecution of butcher for marketing of unsafe food and food hygiene offences arising from 2005 e. coli outbreak resulting in death of Mason Jones.  Managed substantial disclosure process involving 9 counsel.

• DBERR v Muscat – prosecuted bankrupt for offences contrary to Insolvency Act.

• Environment Agency v James – Defended individual prosecuted arising from substantial skip hire business and unlawful dumping.

• Cardiff CC v McDonalds Restaurants – Prosecuted under health and safety legislation arising from electrocution
